    HYPOXIC TRAINING - HEALTH SCREEN AND PERSONAL UNDERTAKING

Introduction
If you plan to become much more physically active (whether using hypoxic training or not) and you have any concerns whatsoever, you should talk with your doctor by phone or in person BEFORE undertaking any activity.

Most of us are able to do most of the activities we may reasonably want - as long as we start slowly and build up gradually. However, it is possible that you may need to restrict your activities to those which are safe for you. If in doubt, talk with your doctor about the kinds of activities you wish to participate in and follow his/her advice.

Exposure to Hypoxia can cause physiological changes to the human body that may vary from person to person. In addition, hypoxic exposure may cause breathing difficulties in certain individuals. Individuals in poor health should take extra precautions or refrain from use of the equipment altogether.

Personal Undertaking
I acknowledge that any subsequent training that I do is carried out at my own risk. I do hereby waive, release and forever discharge The Altitude Centre its agents, employees, representatives, executors, and all others from any and all responsibilities or liability for injuries or damages resulting from my participation in any activities recommended or supervised by The Altitude Centre. I do also hereby release all of those mentioned and any others acting upon their behalf from any responsibility or liability for any injury or damage to myself, including those caused by the negligent act of omission of any of those mentioned or others acting on their behalf or in any way arising out of or connected with my participation in any activities of The Altitude Centre.

Privacy Policy

Collection of Information
Any information that is obtained from the Induction Questionnaire will be treated as privileged and confidential. It is not to be released or revealed to any person except trained Altitude Centre staff without your written consent. The information obtained, however, may be used for anonymous statistical analysis for scientific purposes with your right to privacy retained.



    TERMS OF USE AGREEMENT ("AGREEMENT")

Welcome to The Altitude Centre. This document contains our Terms and Conditions. Please take the time to read the entire User Agreement. This legal notice applies to training advice given, the entire contents of our website under the domain www.altitudecentre.com ("Website") and to any correspondence by e-mail between us and you. Please read these terms and conditions carefully before using our services. Using our services indicates that you accept these terms without modification regardless of whether or not you choose to register with us as a member and constitutes you being a party to this Agreement. If you do not accept these terms, do not use this Website, or seek our training advice. Once you have completed your online registration procedure, your membership has been activated and you have entered into a legally binding contract for the provision of The Altitude Centre service (the "Service").

Eligibility.
You must be eighteen or over to register as a member of The Altitude Centre or use the Website. Membership of the Service is invalid where it has been prohibited. By using the Website, you represent and warrant that you have the right, authority, and capacity to enter into this Agreement and to abide by all of the terms and conditions of this Agreement.

Registration and Subscription.
You may become a member of the Service at no cost. As a member you will have the ability to participate in some, but not all, of the features and services available within the Service. In order to access additional features and services, including the ability to communicate with us, you must become a paying subscriber to the Service. Please see our billing details for a description of the current continuous service rates. This rate list is part of this Agreement. We can change the subscription fees for the Service at any time but we will give you reasonable notice of this before we do so. If you are unhappy with any subscription fee changes you may terminate your membership by writing to our address listed below or by going here.

Scope of Service.
The Scope of Service is as follows: • To provide training advice to those going to altitude, or to incorporate altitude training as part of an overall fitness routine. • The training advice is not a diagnosis or treatment for any disease or illness. • Users of the service will be able to exercise at a simulated altitude of up to 5,000m. The precise level of simulated altitude will be made known to the user before the exercise commences.

Standard Billing.
Most subscription plans to the Service consist of a set fee for a service for an initial period, for which there is a one time charge. By entering into this type of Agreement, you acknowledge that your subscription has an initial payment feature and you accept responsibility and authorise The Altitude Centre to levy such charges.

Recurring Billing.
The altitude centre may introduce new products and services that include a different billing structure, such as Recurring Billing. These services will consist of a set fee for a service for an initial period, for which there is a one time charge followed by recurring period charges as agreed to by you. By entering into this type of Agreement, you acknowledge that your subscription has an initial and recurring payment feature and you accept responsibility for all recurring charges prior to cancellation and authorise The Altitude Centre to levy such charges. The altitude centre may submit periodic charges (e.g., monthly) without further authorisation from you, until you provide prior notice (confirmed in writing upon request by the altitude centre) that you have terminated this authorization or wish to change your payment method. Such notice will not affect charges submitted before the altitude centre reasonably could act. To terminate your authorisation or change your payment method, go to www.altitudcentre.com

Current Information Required.
You must provide current, complete and accurate information for your billing account. You must promptly update all information to keep your billing account current, complete and accurate (such as a change in billing address, credit card number, or credit card expiration date), and you must promptly notify the altitude centre if your payment method is cancelled (e.g., for loss or theft) or if you become aware of a potential breach of security, such as the unauthorised disclosure or use of your user name or password. Changes to such information can be made on the website. If you fail to provide the altitude centre any of the foregoing information, you agree that the altitude centre may continue charging you for any use of the service under your billing account unless you have terminated your subscription for the service (confirmed in writing upon request by the altitude centre).

Term and Termination.
This Agreement will remain in full force and effect while you are a member of the Service. Under the United Kingdom Consumer Protection (Distance Selling) Regulations 2000 (as amended), you can postpone commencement of the Service until the seven working day cooling-off period has expired. However, if you choose to become a member and enter the service, you are electing to commence the Service immediately and you thereby waive any right to cancel the Service under the above Regulations. You may terminate your membership at any time, for any reason, effective upon receipt by us of your written or email notice of termination. We may immediately terminate your membership and your access to the Service at any time because you have breached this Agreement and will send you notice of termination at the email address you provide in your application for membership or such other email address as you may later provide to us. If we terminate your membership of the Service because you have breached the Agreement, we will refund any pre-payments made by you less reasonable costs and losses we have incurred. We can terminate this Agreement at any time by giving you reasonable advance written notice.

If you terminate your subscription, your subscription will remain active until the end of the period through which you had paid prior to your termination. In the case of violation of one or more of the terms of this Agreement by you, we may block your account(s), delete prohibited content. We may also block your access to all or part of the Service, either permanently or temporarily. The Altitude Centre may deactivate the accounts of members who have not used the Service for a period of six months or more (as calculated by the date of last connection to the Service) unless you are a paying subscriber.

Account Security.
You are responsible for maintaining the confidentiality of the username and password that you designate during the registration process with the Service, and you are fully responsible for all activities that occur under your username and password. You agree to (a) immediately notify The Altitude Centre of any unauthorised use of your username or password or any other breach of security, and (b) ensure that you exit from your account at the end of each session. The Altitude Centre will not be liable for any loss or damage arising from your failure to comply with this provision. You should use particular caution when accessing your account from a public or shared computer so that others are not able to view or record your password or other personal information. Customer Service.
The Altitude Centre provides assistance and guidance through its customer care representatives. When communicating with our customer care representatives, you may not to be abusive, obscene, profane, offensive, sexist, threatening, harassing or racially offensive. If we feel that your behaviour towards any of our customer care representatives or other employees is at any time threatening or offensive, we reserve the right to immediately terminate your membership and you will not be entitled to any refund of unused subscription fees.

Copyright Policy.
You may not post, distribute, or reproduce in any way any copyrighted material, trademarks, or other intellectual property or proprietary information without obtaining the prior written consent of the owner of such proprietary rights. Without limiting the foregoing, if you believe that your work has been copied and posted on the Service in a way that constitutes copyright infringement, please provide our Copyright Agent with the following information: an electronic or physical signature of the person authorised to act on behalf of the owner of the copyright interest; a description of the copyrighted work that you claim has been infringed; a description of where the material that you claim is infringing is located on the Website; your address, telephone number, and email address; a written statement by you that you have a good faith belief that the disputed use is not authorised by the copyright owner, its agent, or the law; a signed statement by you, , that the above information in your notice is accurate and that you are the copyright owner or authorised to act on the copyright owner's behalf. Service Access.
While The Altitude Centre endeavours to ensure that its website is normally available 24 hours a day, we do not guarantee that it will be uninterrupted or error free.

If upon receiving any notice, if you do not wish to continue with the Service, you may terminate the contract upon giving us notice, such notice to take effect upon the earlier of our receipt of your notice or the date upon which the amended terms and conditions would otherwise have taken effect. Ownership of rights.

Release.
In the event that you have any claim or action against any other member arising from that member's use of our Website or the Service, you agree to pursue such claim or action independently of and without any demands from us, and you release us from all claims, liability and damages, arising from or in any way connected to the claim or action. In the event that a claim or action is brought against us from your activities or use of the Website or the Service, including any breach by you of this Agreement or any charges or complaints made by other parties against you, you agree to pay, hold harmless and defend us in the claim or action. You also agree to cooperate as fully as reasonably required in the defence of any claim and allow us to assume the exclusive defence and control of the matter.

Severance.
If any part of this Agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely match the intent of the original provision and the remainder of the Agreement shall continue in effect.

Assignment.
The Altitude Centre may, and you may not, assign, convey, subcontract or delegate rights, duties or obligations hereunder.

Relationship.
You agree that no joint venture, partnership, employment, or agency relationship exists between you and The Altitude Centre. as a result of this agreement or use of this Website.

Disputes.
If there is any dispute about or involving the Website and/or the Service, by using the Website, you agree that the dispute will be governed by the laws of England and Wales without regard to its conflict of law provisions. You agree to personal jurisdiction by and venue in the courts of London, United Kingdom.

Disclaimer.
The Altitude Centre requires that you consult with your physician before following any training instructions you receive through The Altitude Centre or participating in any event announced on The Altitude Centre web site. The Altitude Centre is not a licensed medical care provider and represents that it has no expertise in diagnosing, examining, or treating medical conditions of any kind, or in determining the effect of any specific exercise on a medical condition. PLEASE NOTE: Not all hypoxic exercises are suitable for everyone. Before you begin any training instructions you receive through The Altitude Centre or participating in any event announced on The Altitude Centre web site, you should have permission from your doctor to participate in vigorous exercise. If you feel discomfort or pain, do not continue. The instructions and advice presented are in no way intended as a substitute for medical counselling.

Member Responsibility.
We assume members of The Altitude Centre will act responsibly and use the tools provided by The Altitude Centre in a law-abiding manner. If The Altitude Centre determines that any member is not using the system provided by The Altitude Centre responsibly, we can censor, edit or block their transmissions or use of The Altitude Centre system.

Limitation of Liability.
The Altitude Centre and our affiliates and sponsors, are neither responsible nor liable for any direct, indirect, incidental, consequential, special, exemplary, punitive or other damages arising out of or relating in any way to The Altitude Centre's web site, our web site related services and/or content, or information contained within the web site. Your sole remedy for dissatisfaction with The Altitude Centre web site and/or our web site related services is to stop using The Altitude Centre web site and/or those services.

Indemnity.
You agree to defend, indemnify, and hold The Altitude Centre, its officers, directors, employees, agents, licensors, and suppliers, harmless from and against any claims, actions or demands, liabilities and settlements including without limitation, reasonable legal and accounting fees, resulting from, or alleged to result from, your violation of the terms and conditions of this Member Agreement.

General.
The Altitude Centre, in its sole discretion, may revoke the membership of those who violate its guidelines or this Membership Agreement. This Membership Agreement shall be governed by laws of England and Wales without regard to its conflict of law provisions. Any action brought in connection with the Membership Agreement shall be filed within one year of the date of the alleged injury, regardless of any statute of limitations, in a court located in London, UK.

Other.
This Agreement, accepted upon use of the Website and further affirmed by becoming a member of the Service, contains the entire agreement between you and The Altitude Centre regarding the use of the Website and/or the Service. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect.

Goods and Shipping

Postal costs - All orders will be priced according to weight and delivery locaton and quoted at time of order using either DHL or Royal Mail.

Delivery - Subject to availability we aim to dispatch goods within 3-5 working days of receipt of your order. Where delivery charges are not free the charge will be based on weight of the product and the packaging materials required for safe delivery. The full cost of these charges will be displayed next to the item and included in the purchase price.

Damaged Goods - Should you receive goods that arrive damaged you must advise us within seven days of receipt by email. The goods should be returned by a courier that issues a tracking number.

Faulty Goods - If goods are deemed faulty please return within seven days and a full refund will be given or replacement goods supplied.

Cancellation Rights - Under the UK's "Distance Selling Regulations", you have the right to cancel the contract for the purchase of any item within seven working days of delivery. To cancel this contract, simply advise us in writing detailing your Name, Address and give the reason "Cancellation of Contract".

Cancellation Policy - Items can be returned within 14 days of purchase if boxed, unused and in perfect condition, whereby a refund will be given immediately upon receipt of the goods at our premises. Please ensure the goods are packaged securely and sent with a courier on a sign for service. In the event of a cancellation the Customer is responsible for any postal charges incurred.

Courses and equipment rental can be cancelled upto 24 hours prior to your confirmed booking date, whereby a full refund will be given. No refund will be given on courses or equipment rental cancelled less than 24 hourse before the confirmed booking date.

Statutory Rights - None of the above effects your statutory rights as a customer

Collection of Information
No information is collected on this web site altitudecentre.com other than that which you may use to communicate with us. All personal information used when making a purchase is entered into "PayPal's" secure web server and is subject to Paypal's Security Policy, and Terms and Condition. PayPal will notify us of any purchases and present us with some personal information to enable us to deliver the purchaser's goods.

Order
PayPal Online Orders We will receive information from Paypal about the purchaser's order such as name, address and contact details. This information is used for billing purposes and to fulfil the purchaser's order. If we have trouble processing an order, the contact information is used to get in touch with the purchaser. It is also important to note that The Altitude Centre does not store financial details at any time. All credit card details that are entered into PayPal are used for that single transaction only. At no time in this process does The Altitude Centre have any access to the purchaser's credit card details.

Telephone Orders
Orders taken over the telephone utilise the Paypal "virtual terminal". We have to request information such as name, delivery address and contact information in order to process your order and send you the goods you order. Your delivery address, name and telephone number will then be passed to the delivery companies so they can affect delivery of the products you purchase, however we do not keep hold of your financial information and this is not passed on to any delivery companies.

We do not keep your credit or debit card details on record. For your absolute safety your financial information is not shared with any other parties, other than those listed above.
